These Jaya Grocer Gift Card Terms and Conditions (“Terms & Conditions”) apply to the usage and other relevant matters of Jaya Grocer Gift Cards. Consumers (users) are advised to read these Terms & Conditions carefully.
WE RECOMMEND YOU KEEP A COPY OF THESE TERMS & CONDITIONS FOR YOUR RECORDS. By purchasing and/or using the Jaya Grocer Gift Card, you and the holder of the Jaya Grocer Gift Card are deemed to have accepted these Terms & Conditions herein contained.
Interpretation
Wherever the word “WE” or “US” or “OUR” appears in relation to these Terms & Conditions and/or the Gift Card, it shall mean and/or refer to Trendcell Sdn. Bhd. including its successors, assigns, officers, directors, shareholders, agents, affiliates, and subsidiaries unless otherwise indicated.
“You” or “Consumers” are persons who are in possession of the Gift Card either by purchase or by gift or otherwise for the purpose of using the Gift Card as a payment method at Jaya Grocer outlets nationwide subject to these terms and conditions.
Reference to “card”, “gift card”, or “Jaya Grocer gift card”, where the context so requires, refers to the “Jaya Grocer Gift Card”.
PART ONE: JAYA GROCER GIFT CARD GENERAL TERMS
Our Gift Cards can be honoured at all Jaya Grocer physical outlets in Malaysia, EXCEPT Hock Choon Supermarket, Central Mart, JayaGrocer.com, and Jaya Grocer on GrabMart. The value of this card or denomination is in Malaysian Ringgit only.
Initial Stages of Purchase
You are responsible for ensuring that the Gift Card is not scratched, damaged, and/or effaced as scratched, damaged, and/or effaced card is not redeemable, exchangeable, refundable, or replaceable.
Usage of the Gift Card
The Gift Card is to be treated like cash for payment at Jaya Grocer participating outlets only. By presenting your Gift Card at a Jaya Grocer outlet, the outlet will accept the Gift Card as a method of payment. Gift Cards are not redeemable or exchangeable for cash. Gift Cards cannot be returned once sold. Gift Cards cannot be loaded with value and the amount(s) cannot be transferred. If you wish to purchase any products of a higher value than the available value in the Gift Card, the difference can be paid by cash, credit card, GrabPay, and/or any other payment methods accepted by us which shall be advised from time to time.
Please keep the Gift Card safe and it is equivalent to cash, in that a holder in possession of a valid Gift Card shall be recognised as the rightful owner without further query. No registration of the Gift Card is necessary. Possession of the Gift Card constitutes ownership.
The Gift Card is not a credit, debit, or loyalty card. The designated monetary value loaded on your Gift Card is a pre-payment only for the goods and services of our outlets. No refund of the balance in the Gift Card is allowed due to any reason(s), including but not limited to the theft, damage, and/or loss of the Gift Card.
Effaced, mutilated, duplicated, damaged, torn, or altered gift cards will be considered invalid and will not be replaced or refunded by Jaya Grocer, and cannot be redeemed at any Jaya Grocer outlet.
Redemption
The Gift Card can be used only once and is valid for a single transaction only. Any balance remaining in the Gift Card cannot be refunded in any way and shall lapse and cease to have effect on the said transaction. There is no limit on the number of Gift Cards that can be used in a single transaction.
The Jaya Grocer Gift Card cannot be used online on the website www.jayagrocer.com or on the Grab App or GrabMart platform.
Lost or Stolen Card
This gift card falls under the responsibility of the bearer. Jaya Grocer shall not be held responsible or liable for the loss, damage, or theft of this gift card, or any of the losses or damages suffered by the bearer of the Gift Card that may arise from the loss or damage of this gift card. As the bearer of the Gift Card, you shall use all precautions to prevent the loss and/or theft and/or unauthorised use of the Gift Card. Jaya Grocer will not entertain any request(s) for balance refund(s) or monetary claims pertaining to the lost or stolen Gift Card.
Receipts and Statements
A single Jaya Grocer Gift Card can be purchased up to a maximum value of its denominated value RM200, RM100, RM50 or RM10) at all participating Jaya Grocer outlets.
Consumers are not allowed to use an existing Gift Card to purchase another Gift Card. This restriction is in place to prevent the extension of expiry periods through repeated Gift Card purchases.
Replacement Card
If a Gift Card becomes faulty or damaged due to a manufacturing or technical defect, please go to our nearest outlet and request for a replacement Gift Card. Any request for a replacement Gift Card must be supported with the proof of purchase (original receipt) and the existing faulty Gift Card which will have to be returned back to us in good condition (and not effaced, mutilated, damaged, dented, or scratched). No card replacement will be entertained without the original Gift Card being returned. Each card replacement will be allowed once only. There is no replacement fee for any successful request for a replacement card.
Activation and Expiry
Gift Cards will be activated immediately upon purchase at any of our participating Jaya Grocer cashier counters. Gift Cards cannot be redeemed for any activities or transactions other than purchasing item(s) sold at our participating outlets. Gift Cards are valid for one (1) year only from the date of purchase/card activation. Strictly no extension of the validity period will be allowed and any balance left on the Gift Card after the expiry of the validity period will be forfeited.
No refunds or requests for renewal will be entertained or accepted.
Fraudulent and Misused Gift Cards
If we suspect misuse or fraudulent use of our Gift Card, we may suspend, cancel or terminate the Gift Card to prevent further misuse or fraudulent use of the Gift Card. The Gift Card remains as our property.
Discontinuation of Gift Card Programme
Jaya Grocer reserves the right to amend or discontinue the use of the Gift Card without prior notice. We may, at our discretion, discontinue the Gift Card programme/service by giving sixty (60) calendar days’ notice of such discontinuation. Notice of such discontinuation may be sufficiently sent by way of publication on our website or notification by way of announcement at our participating outlets or on our social media platforms/website
Upon the discontinuation date, all cards purchased prior thereto will remain to be valid until their respective expiry dates. No further Gift Card(s) shall be issued and/or recognised as valid should its date of purchase/card activation be a date on or after the discontinuation date of this Gift Card programme/service.
PART TWO: IMPORTANT LEGAL TERMS
Changes to This Agreement
We reserve the right to amend these Terms & Conditions at any time without prior notice for any reasons.
We will post the terms of the updated Terms & Condition on our website at https://klec.jayagrocer.com/pages/jaya-grocers-gift-card-terms-and-conditions. Any change, addition, or deletion will become effective at the time we post the revised agreement to our website or generally in our participating outlets or as otherwise stated in our notice to you. Unless we state otherwise, the change, addition, or deletion will apply to all existing and future Gift Cards.
Cancellation of This Agreement
We may suspend or terminate your Gift Card at any time by giving you reasonable prior notice. We need not, however, give you notice where we have serious grounds for considering that immediate termination is required (e.g. if we reasonably suspect fraudulent or unauthorised use of the Gift Card). Termination of your Gift Card, for any reason, shall be without prejudice to any of our rights and remedies that have accrued prior to the date of termination.
Disclaimers and Limits of Liability
We do not represent or warrant that your Gift Card will always be accessible or accepted at all of our outlets in Malaysia. To the maximum extent permitted by law, our liability in all circumstances, is limited to the total amount available in the Gift Card. We will not be liable to you or any third party authorised by or claiming through you for any loss, damage, cost, expenses, actions, suits, claims, and demands whatsoever, whether direct, indirect, special, or consequential, of loss of business, revenue, or profits, or of any nature suffered by you or any person for any loss, damage, or injury caused or suffered by a person arising from the usage of the Gift Card, including but not limited to the delays caused by our system or for:
● any loss of income, business, goodwill, or profits arising out of this agreement;
● any unauthorised access to or alteration, theft, or destruction of your Gift Card;
● the consequences of any delay or mistake relating to the use of your Gift Card caused by any circumstances beyond our control;
● any loss or damage which was not caused by our breach of this agreement or breach of our legal duty of care;
● any loss or damage which was not a reasonably foreseeable result of either our breach of this agreement or breach of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time we entered into this agreement, such loss was contemplated by you and by us; or
● any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.
Governing Law
These Terms & Conditions shall be governed by the laws of Malaysia.
Entire Agreement; Construction
These Terms & Conditions are the complete and exclusive agreement between you and Trendcell Sdn. Bhd. and supersedes all prior proposals and all other agreements in respect of the usage of the Gift Cards. If any provision of these Terms & Conditions is illegal or unenforceable, that provision will be deleted from this agreement, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of this agreement.
We shall not be liable for any loss or inconvenience faced by you resulting from the amendment(s) of these Terms and Conditions.
